TERMS & CONDITIONS AND WAIVER

I understand that I should not compete in this event unless I have trained and prepared appropriately for it. My physical condition has been verified by a medical practitioner, or I confidently believe that I am sufficiently fit and healthy to compete in this event and can tread water in a fatigued state for at least two (2) minutes.

I acknowledge that ocean swimming involves real risks of serious injury or even death from various causes, including overexertion, equipment failure, falling debris, contact with structures, dehydration, and/or accidents with other competitors.

By competing, I accept all risks necessarily arising from my participation, which could result in loss of life or permanent injury. Accordingly, I release all persons or corporations associated directly or indirectly with the conduct of the event from all claims, demands, and proceedings arising out of my participation, and I hereby indemnify them against all liability (including liability for their negligence and the negligence of others) for any injury, loss, or damage arising out of or connected with my participation in this event. This release extends to and includes The Event Crew Limited and their respective directors, partners, managers, officers, agents, contractors, employees, and volunteers—including medical and paramedical personnel appointed for the event—as well as the owners, licensees, and occupiers of land upon which the event or any part of it is conducted, any statutory body or local authority having control over any land on which the event or any part of it is conducted or which is involved directly or indirectly with the event in any manner whatsoever, and promoters, sponsors, and event organisers. This release and indemnity continue indefinitely and bind my heirs, executors, personal representatives, and assigns.

I accept that it is my responsibility to contact the event organisers should any information on my entry form need to be updated (e.g., emergency contact details).

I understand that if I am entering a swim distance of 2 km or more for the first time, the New Zealand Ocean Swim Series organisers recommend that I first complete a swim distance of 1.25 km or less before attempting the longer swim.

I acknowledge that the event organisers will endeavour to provide a true and accurate course distance, but the distance may vary due to tidal flows and ocean conditions.

I consent to receive any medical treatment that the event organisers consider necessary during or after the event.

I consent to the event organisers using my name, image, and likeness before, during, or after the event for promotional purposes, including marketing materials, social media, official sponsor campaigns, broadcasting, or reporting in any media.

I consent to Event Crew Limited providing my personal details to a professional photography company or media agency if contracted by Event Crew Limited to photograph participants at the event.

I understand that safety precautions undertaken by organisers (such as course supervision and event safety briefings) are a service to me and other competitors but do not constitute a guarantee of safety.

I accept my responsibility to listen to all pre-event safety briefings and immediately seek clarification from an event official regarding anything unclear to me.

I am fully responsible for the security of my personal possessions at the event.

I understand that no refunds will be given for any reason, including but not limited to sickness, injury, or personal circumstances. If I cannot participate, my registration may be transferred to another event this season under the following conditions:

• Single Event: If the transfer is arranged at least 7 days before event day, 75% of the registration fee can be transferred to another event this season.

• Multi-Event Pass: Transfers to another event this season can be arranged at least 7 days before event day. To transfer to a different event, I must pay a $15 transfer fee and email the team to organise it. If I do not contact the organisers to arrange a transfer, my registration fee is neither refundable nor transferable.

I agree to abide by all event rules and directions issued by the event organiser. These rules are listed at https://www.oceanswim.co.nz/event-safety.

I will wear the event timing chip as directed by the event organisers. I must return the timing chip after the event (whether I participate or not); otherwise, I agree to pay a $50 fee for its non-return.

I agree to my name and contact details being included on the Event Crew Limited event and email databases. Event-specific email communications and messages from event partners will be sent to me. I can unsubscribe from these at any time.

I acknowledge that circumstances beyond the control of the event organisers may require changing the event format. If that occurs, I consent to those changes and agree that each condition herein applies to the revised event.

Due to committed outgoing costs, if the event is cancelled due to any ‘act of God or nature,’ strike, lockout, fire, flood, storm, explosion, revolution, riot, act of war, earthquake, landslide, epidemic, pandemic, national day of mourning, or any other act or event beyond the organisers’ reasonable and foreseeable control, I understand that my entry fee will not be refunded.

I certify that I meet or exceed the minimum age requirement specified for my chosen event. The minimum age as of event day is 12 years old for swim distances of 2 km and above.

If I am younger than 16 years of age, my legal guardian has viewed and agreed to these Terms and Conditions through the online entry process, thus giving consent for me to compete. Children under 16 must have a high level of ability and fitness suitable for their chosen event category, with parental guidance required.
